These Terms of Service ("Terms") govern your access to and use of the Yosemite West Cabins website (yosemitewestcabins.com) and your stay at our vacation rental properties located at 7240 Yosemite Pkwy (El Capitan Hideaway) and 7240A Yosemite Pkwy (Half Dome Haven), Yosemite West, California 95389.
By accessing our website, making a reservation, or staying at our properties, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Reservations and Booking
1.1 Reservation Confirmation
A reservation is confirmed upon receipt of a booking confirmation email and any required deposit or full payment. We reserve the right to decline any reservation at our discretion.
1.2 Guest Age Requirement
The primary guest ("Booking Guest") must be at least 25 years of age. The Booking Guest is responsible for all guests on the reservation and any damages or violations of these Terms.
1.3 Accurate Information
You agree to provide accurate and complete information at the time of booking, including the true number of guests. Misrepresentation may result in cancellation without refund.
2. Payment Terms
2.1 Rates and Fees
Rental rates are as displayed at the time of booking. Rates are subject to change and are not guaranteed until a reservation is confirmed. Additional fees may include cleaning fees, security deposits, and applicable taxes.
2.2 Security Deposit
A refundable security deposit may be required and will be collected at the time of booking or at check-in. The deposit will be returned within 7–14 business days after check-out, less any deductions for damages, excessive cleaning, or policy violations.
2.3 Payment Methods
We accept major credit cards and other payment methods as listed during checkout. Payment processing is handled by our secure third-party processor.
3. Cancellation Policy
3.1 Standard Cancellation Terms
- More than 30 days before check-in: Full refund of rental amount, less any non-refundable processing fees.
- 15–30 days before check-in: 50% refund of the rental amount.
- Less than 15 days before check-in: No refund. The full rental amount is non-refundable.
3.2 Modifications
Reservation modifications (date changes, guest reductions) are subject to availability and may result in rate adjustments. Shortening a stay within 30 days of check-in does not entitle you to a refund for unused nights.
3.3 Travel Insurance
We strongly recommend purchasing travel insurance to protect against unforeseen circumstances. We are not responsible for cancellations due to weather, road conditions, health issues, personal emergencies, or Yosemite National Park closures.
3.4 Force Majeure
In the event of a force majeure (natural disaster, government-mandated closure, pandemic restrictions), we will work with guests on a case-by-case basis to reschedule or provide credit. Cash refunds due to force majeure are at our discretion.
4. Check-In and Check-Out
- Check-In: 3:00 PM or later on your arrival date. Self check-in via keypad — access codes provided 24 hours before arrival via email.
- Check-Out: 11:00 AM on your departure date.
- Early Check-In / Late Check-Out: May be available on request and subject to availability. Additional fees may apply.
- Check-Out: 10:00 AM. No late check-out is available — our cleaning crews need the full window to prepare for incoming guests.
5. House Rules and Guest Responsibilities
5.1 Maximum Occupancy
Guests may not exceed the maximum occupancy listed for each property: El Capitan Hideaway (up to 7 guests) and Half Dome Haven (up to 4 guests). Exceeding occupancy limits may result in immediate termination of the stay without refund.
5.2 No Parties or Events
Our properties are strictly residential vacation rentals in a private community. Parties, events, gatherings beyond registered guests, and excessive noise are strictly prohibited. Violations will result in immediate eviction without refund and potential additional charges.
5.3 Smoking Policy
Smoking (including cigarettes, cigars, vaping, and cannabis) is strictly prohibited inside both properties and within 25 feet of any structure. Violations will result in a minimum $500 cleaning fee deducted from the security deposit.
5.4 Pets
Pets are permitted only at El Capitan Hideaway (maximum 1 well-behaved dog) with prior approval and payment of the pet fee. Pets must be kept off furniture and beds, and must never be left unattended in the property. Guests are responsible for all pet damage and waste cleanup. Pets are NOT permitted at Half Dome Haven.
Note: Yosemite National Park has strict regulations regarding pets on trails and in most areas of the park. Please review current NPS rules before your visit.
5.5 Noise and Neighbor Respect
Quiet hours are 10:00 PM to 8:00 AM. Yosemite West is a private residential community. Please respect neighbors and maintain reasonable noise levels at all times.
5.6 Property Care
Guests are responsible for leaving the property in the same general condition as found. This includes: washing dishes and returning them to storage; disposing of garbage in designated bins; not rearranging or damaging furniture; and reporting any damage or maintenance issues promptly.
5.7 Fire Safety
Due to the wildfire risk in the Sierra Nevada, outdoor fires are only permitted in designated fire rings and only when local fire restrictions allow. Check current CAL FIRE and Yosemite NPS restrictions before making any outdoor fires. Guests are responsible for full compliance with all fire regulations. Violation may result in substantial fines and liability.
5.8 Parking
Parking is available on site. Please park only in designated areas. The driveway is shared between El Capitan Hideaway and Half Dome Haven — please keep access clear at all times.
6. Yosemite National Park Rules
Both properties are located within the boundaries of Yosemite National Park in the Yosemite West private residential community. All guests must comply with all applicable National Park Service regulations while staying at our properties and while within the park. This includes wildlife regulations, trail rules, speed limits, and Leave No Trace principles. Violations of NPS regulations are the sole responsibility of the guest.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Yosemite West Cabins and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or your stay at our properties. Our total liability to you for any claim arising out of your reservation shall not exceed the total rental amount paid for your stay.
We are not responsible for: theft of personal belongings; injuries occurring on the property or in the surrounding area; loss of enjoyment due to weather, wildlife, or natural conditions; road closures or park access restrictions; or interruptions in utilities (power, water, internet).
8. Indemnification
You agree to indemnify, defend, and hold harmless Yosemite West Cabins, its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of our services, your stay at our properties, violation of these Terms, or violation of any applicable laws.
9. Damage and Liability
Guests are financially responsible for any damage to the property, its contents, or adjacent structures caused by the guest or any person in the guest's party. We reserve the right to charge the credit card on file for documented damages exceeding the security deposit. We will provide photographic evidence and itemized costs for any charges.
10. Website Use
You agree to use our website only for lawful purposes. You may not attempt to gain unauthorized access to any portion of the website, interfere with its operation, or use automated tools to scrape or copy website content. All content on this website is the property of Yosemite West Cabins and may not be reproduced without written permission.
11. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or your stay shall be resolved through binding arbitration in Mariposa County, California, except that either party may seek injunctive relief in court for intellectual property violations.
12. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes constitute acceptance of the modified Terms. For active reservations, the Terms in effect at the time of booking shall apply.
